The general terms and conditions of business for the online store Lumerie.eu (Lumerie) are composed in accordance with the Consumer Protection Act (ZVPot)., based on recommendations GZS and international codes of conduct for e-commerce.
The general terms and conditions of business address the operation of the online store Lumerie.eu, the rights of the user, and the business relationship between the provider and the customer.
With the online store www.lumerie.eu managed by Farmatic, trading and consulting, ltd. (hereinafter referred to as: provider).

General terms and conditions of the online store Lumerie are composed in accordance with the Consumer Protection Act (ZVPot),Law on the Protection of Personal Data (ZVOP-1), Law on eCommerce on the Market (ZEPT) and Law on Electronic Communications (ZEKom-1). Online store Lumerie is an information system designed to present and sell products to the user. It is managed by the company Farmatic, d.o.o., hereinafter referred to as: the provider/seller/store/Lumerie/company. The user is a person who uses our system or website, especially a buyer in the online store.

The customer or user is bound by the general terms and conditions that are valid at the time of submitting the online order. The user is notified of the general terms of business, which must be confirmed and agreed to before placing the order. The general terms and conditions are an integral and inseparable part of the sales contract.

2. Information access

The provider undertakes to always provide the following information to the customer:
-identity of the company (name and registered office of the company, registration number)
-contact information that allows the user to communicate quickly and effectively (email, phone)
-essential features of the goods or services (including after-sales services and guarantees)
-availability of products (each product or service that is offered on the website should be available within a reasonable time)
-conditions for delivery of the product or performance of the service (method, place and time of delivery)
-all prices must be clearly and unambiguously determined and it must be clearly shown whether they already include taxes and transport costs
- payment method and delivery
-time validity of the offer
-deadline for withdrawal from the contract and the conditions for withdrawal; also, if and how much it will cost the buyer to return the product
-explanation of the complaint procedure, including all information about the contact person or customer service department

3. Registration

The user can place an order at Lumerie as a guest or as a registered user. The registration process is simple and quick. By logging in to the website, the buyer creates their own account through which they can manage their data, delivery addresses, review order statuses and track them. Each registered user has their own username and password to identify themselves. The password is secret and known only to the user. The username is composed of the email address entered by the user. The user receives a confirmation email to the email address for final login or registration. The user is obliged to ensure that only they or a person authorized to act on their behalf will use their name and password. By registering on the website, the user also has an easier overview of their purchases.

4. Prices and delivery costs

All prices on the website are in euros (€) and include value-added tax (VAT), unless stated otherwise on the website. All prices in the online store are product prices and do not include postal or delivery costs, which are charged additionally. The buyer is informed of the amount of delivery costs in the summary of the order, before confirming the order with the obligation to pay, with a separate display of the amount of these costs. Delivery costs are shown both on the order and on the invoice for the issued goods, and the buyer pays them together with the amount of the order. The delivery cost is part of the final price of the entire order. The delivery cost is calculated automatically when ordering the goods and will be displayed upon completion of the order, before the buyer submits the order with the obligation to pay. The delivery cost depends on the size, dimensions and weight of the shipment and includes delivery costs and packaging and preparation costs. The delivery cost may change according to the current price list of the delivery service, but the delivery cost cannot be changed after the moment when the contract is considered concluded according to the General Terms and Conditions.

Regular prices Apply to all users (registered and unregistered) of the Lumerie website and do not have a predetermined validity and can be changed at any time without prior notice.

Despite exceptional efforts to provide the most up-to-date and accurate data, it may happen that the price information is incorrect. In this case, or if the price of the item changes during order processing, the provider will allow the customer to withdraw from the purchase and will offer the customer a solution that will be mutually satisfactory.

5. Payment methods

Payment by credit cards takes place through the Stripe payment system. Card data is not recorded on the company's server, so the buyer's security is ensured. Stripe ensures maximum transaction security. Credit card authorization is carried out in real time with immediate verification of data with banks. Payment is possible with the following cards: Mastercard, Visa, Visa Electron, American Express, Discover, Diners, JCB, and Maestro (if the payer's Maestro payment card allows it).

Payment by proforma invoice/prepayment to the business account of the provider Farmatic, trading and consulting, d.o.o., Novi trg 9, 8000 Novo mesto, bank account opened at NLB d.d., IBAN (: SI56 0294 5026 3561 933, SWIFT/BIC: LJBASI2X. The buyer will receive the proforma invoice by email, the payment deadline for the proforma invoice is five (5) working days from the receipt of the proforma invoice.Timely payment of the proforma invoice is an essential part of the contract. If the proforma invoice is not paid by the payment deadline, the contract is deemed terminated by law and the provider is no longer obliged to reserve the ordered products and is free from all obligations under this specific order.

6. Invoicing

Farmatic, d.o.o. operates as a company that offers goods or services over the internet under the brand name Lumerie. The customer pays the total amount of the order to the company Farmatic, d.o.o. The customer receives the issued invoice by email, which was submitted during the order process, after the sales contract has been concluded. The provider operates in the Republic of Slovenia, and ships products to the Republic of Slovenia and abroad, particularly to EU member states. The invoice itemizes the price and all costs related to the purchase (possible additional charge for delivery/postage, payment cost, depending on the payment method) and informs the customer of the right to withdraw from the contract.

7. Delivery

Delivery within the Republic of Slovenia
When ordering a product in the online store, the customer can choose one of the following delivery options:
At the time of placing an order for a product in the online store, the customer can choose one of the following delivery options: Delivery to the customer's home address, provided by the supplier through contracted partners/delivery services. The contracted partner for delivery of shipments is DPD, courier and package distribution ltd., however, the supplier reserves the right to choose another delivery service if it can fulfill the order more efficiently. Transportation, postal or any other costs related to this (hereinafter: delivery costs) are not included in the price of the product and are charged separately. The customer is informed about the amount of delivery costs in the order summary before confirming the order and paying, with a separate display of the amount of these costs. Delivery costs are charged and stated on the order as well as on the invoice for the issued goods, and the customer pays them together with the amount of the order. The delivery cost is calculated automatically when ordering the goods and will be displayed upon completing the order, before the customer submits the order and pays. Delivery to foreign countries
The supplier delivers to most European countries, especially EU member states. The cost of transport, postage or any other costs associated with this (hereinafter: delivery costs) are not included in the price of the product and are charged separately. The customer is informed of the amount of delivery costs in the summary of the order, before confirming the submission of the order with the obligation to pay, with a separate display of the amount of these costs. The delivery cost is part of the final price of the entire order. Delivery costs are charged and indicated both on the order and on the invoice for the issued goods and the customer pays them together with the amount of the order. The international delivery lead time for items in stock with the supplier is typically 2-10 working days from the date of receipt of payment in the case of payment by pro forma invoice or from the date of payment by credit card or from the date of submission of the order in the case of payment by cash on delivery or payment by payment cards.

8. Stock and availability

Availability data (stock) of products is displayed in the description of each product and under the title of the product in the shopping cart. The ordered products are delivered within the timeframe specified in the order confirmation. In the case of an increased volume of orders during seasonal sales and special promotions published on the website, the delivery time may be extended by up to 7 working days, which the provider will inform the customer of before the order is placed. The provider is not responsible for any possible extension of the delivery period or for the inability to deliver due to reasons on the part of third parties or for reasons that the provider has no influence on.

8.1. PURCHASE PROCEDURE (BEFORE PLACING AN ORDER)

1. Products selection
Before placing an order in the online store, you must select the desired products. You can do this by clicking on the "Add to Cart" button for each product.
2. Confirming the shopping cart
After selecting the desired products, you can proceed to the shopping cart or checkout page (link to page: https://www.lumerie.eur/checkout). Here you can review your selected products and change their quantity accordingly, add new products or remove them from the cart. A special discount field called "Discount code" is also enabled on this page.
3. Login
In this step of the purchase, it is necessary to log in and submit personal data. The submission of personal data is only for the purpose of delivery and is in accordance with GDPR. You can make a purchase as a guest (quick purchase, without further storage of data) or register and complete the purchase through the registration process.
Address
When selecting a address, specify your desired delivery address. The delivery address can be different from your personal address - in this case, we will send the selected items to the selected address.
5. Delivery
When choosing a delivery, you can choose the delivery method (DPD Slovenia, personal pickup of order) by clicking on the desired delivery. 
6. Payment
The final step is for final checking and confirmation of your order. By clicking the button, you agree to the submitted order and the terms of business and finally confirm your purchase. 

8.2. PURCHASE PROCESS (AFTER SUBMITTING ORDER)

1. Order in processing
"After placing an order, the customer receives an email notification that the order has been accepted for processing.
2. Order confirmed
The order goes into further processing when the provider reviews the order, checks the availability of the ordered items, and confirms or rejects the order for a reason. The provider may call the customer at the contact phone number provided when placing the order to verify data or ensure the accuracy of delivery. Upon confirmation of the order, the provider will notify the customer by email of the expected delivery date. The contract for the purchase of the ordered items between the customer and the provider is irrevocably concluded at this stage.
3. Order placed for delivery
"After the order is confirmed and the ordered goods are handed over for delivery/prepared for delivery or personal pickup, the customer will receive an email notification "Order has been shipped...".

9. Purchase security

The provider uses appropriate technological and organizational measures to protect the transmission and storage of personal data and payments. For this purpose, the provider uses an SSL certificate issued by an authorized organization. Credit card authorization is carried out in real-time with immediate checking of data with banks. Card data is not stored on the provider's server.

10. Damaged shipments

If the customer notices that the shipment (or the item in it) is physically damaged, the contents are missing from the shipment, or the shipment shows signs of opening upon receipt from the delivery service, they must immediately inform the provider and the delivery service that carried out the delivery of the damage, missing content, or signs of opening, upon receipt at the latest, but within 3 days of delivery. Upon request by the delivery service or the provider, the customer must also fill out any necessary forms and provide the required evidence necessary to process the complaint or appeal by the delivery service. The customer must also provide the provider (and upon request, the delivery service) with photographs of the shipment, the label on the shipment indicating the delivery service (information on the shipment number, performer of the delivery, etc.), the damaged (internal and/or external) packaging, the damaged item, and a brief description of the damage, together with the notification from the first paragraph, for the purpose of insurance and submission of evidence. If the customer notices damage to the shipment or visible signs of opening the shipment upon delivery, the customer can refuse to accept such a shipment (if possible, photograph the shipment as well) and immediately inform the provider by email. reklamacije@lumerie.eu or by phone at +386 64 121 460.

11. The customer's right to withdraw from the contract

The customer who orders products in the LUMERIE.EU online store (www.lumerie.eu), can, if they are not satisfied with the ordered products or wish to withdraw from the contract (purchase) for any reason, within 14 days of receiving the product, inform (in writing or by email: reklamacije@lumerie.eu) the provider that they wish to withdraw from the contract without having to provide a reason for their decision. The customer must then return the goods in their original and undamaged condition within 14 days of sending the notification to the company (at the following address: Farmatic d.o.o., Novi trg 9, 8000 Novo mesto). Within 14 days of receiving the notification, we will refund all payments made by the customer without the customer having to request it."

The customer fills out the Form for withdrawal from the contract (or writes a statement with all the required information in the form) and sends it to the provider by email at the following address reklamacije@lumerie.eu or via post mail to the address Farmatic, trgovina in svetovanje, d.o.o., Novi trg 9, 8000 Novo mesto. The provider will promptly confirm receipt of the notice of withdrawal from the contract on a durable medium.

12. Material defect

Consumer can assert their rights based on a material defect if they notify the seller of the defect within two months of the day the defect was discovered. The consumer must describe the defect in detail in the notification of the defect and allow the seller to inspect the item. The notification of the defect can be delivered to the seller in person, in which case the seller must issue a certificate, or send it to the store where the item was purchased or to the seller's representative with whom the contract was concluded. The seller is not liable for material defects in the goods that are discovered after two years have passed since the item was delivered.

It is considered that the defect in the item existed at the time of delivery if it appears within six months of delivery. The rights of the consumer specified in the first paragraph expire after two years from the date the consumer notified the seller of the material defect. The consumer who has properly notified the seller of the defect has the right to demand from the seller that the defect in the item be corrected or a proportionate part of the paid amount be returned in relation to the defect or the defective item be replaced with new flawless goods or the paid amount be returned.

If the existence of a defect in the goods or an irregularity in the service provided is not disputed, the company must comply with the consumer's request from Articles 37c and 38 of this law as soon as possible, but no later than within eight days. The company must provide a written response to the consumer's request no later than within eight days of receiving it if the existence of a defect in the goods or an irregularity in the service provided is disputed.

13. Protection of personal data

The provider undertakes to permanently protect all personal data of the user. The provider will use personal data exclusively for the purposes of fulfilling the order (sending informative material, offers, invoices) and other necessary communication.
By submitting his e-mail address, the user gives his explicit consent that Farmatic d.o.o. can process the entered personal data for the purpose of determining the user's interest in Farmatic d.o.o. solutions, services and products.
Under no circumstances will the user's data be given to unauthorized persons. The user himself is also responsible for the protection of personal data by ensuring the security of his username and password.

14. Communication

The provider will contact the user via means of remote communication only if the user does not expressly object to this.
Advertising emails will contain the following components:

  • they will be clearly and unequivocally marked as advertising messages;
  • the sender will be clearly visible; various campaigns, promotions and other marketing techniques will be marked as such. Also, the conditions of participation in them will be clearly defined;
  • the method of unsubscribing from receiving advertising messages will be clearly presented;
  • the provider will expressly respect the user's wish not to receive advertising messages.

15. User comments

Opinions or comments of users and product reviews written by customers are part of the functionality of the store, which are intended for the community of users. The provider allows any registered store user to write an opinion, and the provider reviews them before final publication. The provider will not publish opinions or contributions that are in any way offensive or, in the provider's opinion, do not provide benefits to other users and visitors. By submitting an opinion or comment, the user expressly agrees to the terms of use and allows the provider to publish part or the entire text in all electronic and other media. The provider has the right to use the content indefinitely and for any purpose that is in the provider's business interest, including publication in advertisements or other marketing communications. At the same time, the author of the opinion declares and guarantees that he is the owner of the material and moral copyrights for the written opinions and comments, and that he transfers these rights to the provider non-exclusively and indefinitely.

16. Copyright

The Lumerie.eu online store and all content published on the website and in the online store (including images, online text, product descriptions, descriptions of trademarks, technologies, blog posts, etc.) are the property and copyright of Farmatic d.o.o. or by Farmatic d.o.o. can legitimately use on the appropriate legal basis, insofar as it concerns content or material that is the property or which is copyrighted by a third party. 

17. Graphics and photographs

The provider strives to provide appropriate images for all products for sale on the website and makes every effort to ensure that there are no aesthetic differences between the photo and the actual product. Possible minimal (especially aesthetic) differences between the products and the display in the online store do not represent a real product defect.
Photos, pictures or recordings published within the offer are the property of Farmatic d.o.o. or its suppliers, business partners.

18. Limitation of liability

The provider makes every effort to ensure that the information published on its pages is up-to-date and correct. Nevertheless, the characteristics of the items, the delivery time or the price can change so quickly that the provider is unable to correct the information on the web pages. In such a case, the provider will inform the customer about the changes and allow him to withdraw from the order or exchange the ordered item.

19. Complaints and dispute resolution

The provider complies with applicable consumer protection legislation. The provider makes every effort to fulfill its duty and to establish an efficient system for dealing with complaints and to designate a person with whom, in case of problems, the buyer can contact by phone or e-mail.
Within five working days, the provider will confirm that it has received the complaint, inform the customer how long it will take to process it and keep him informed about the progress of the procedure. The provider is aware that an essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle for the consumer not to initiate a dispute before the court. The provider does not perform out-of-court settlement of consumer disputes. Therefore, the provider makes every effort to resolve any disputes amicably. If an agreement is not possible, the court in Novo mesto is competent for disputes.

Farmatic d.o.o., which as a provider of goods and services under the Lumerie brand enables online trade in the EU, publishes on its website an electronic link to the platform for the online resolution of consumer disputes (SRPS). The aforementioned regulation comes from the Act on the Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on the online resolution of consumer disputes and the amendment of Regulation (EC) no. 2006/2004 and Directive 2009/22/EC.
